Jeffrey R. Loew

Mr. Loew has significant experience in a wide range of civil litigation matters, with a focus on two areas: estate, trust and probate-related litigation, including claims of elder abuse; and commercial and business litigation. Mr. Loew has represented clients at both the trial and appellate levels. He has successfully represented numerous clients in alternative dispute resolution, including mediation and arbitration.

Prior to joining Carr McClellan, Mr. Loew was an attorney at Cooley Godward Kronish LLP in Palo Alto, where he managed all aspects of general commercial and securities litigation, as well as various copyright, trademark, employment, immigration, and antitrust matters, with a focus on clients in the technology sector.

Recent Experience Includes:

  • First chair on three-day bench trial in San Francisco County Superior Court involving issues of adverse possession and probate claims, including undue influence allegations, asserted by estranged heirs to $2 million multi-unit residential complex. Client prevailed on all counts and dissenting heirs’ claims were dismissed.
  • Briefed and argued before California First District Appellate Court, on behalf of trust beneficiary, a challenge to the Superior Court’s ruling that although a caregiver was the drafter of instruments benefiting herself at the expense of her elderly client and his trust, the caregiver could nonetheless rebut the presumption of fraud and undue influence.
  • Opposed summary judgment motion asserting that apartment complex providing emergency call service for disabled residents was not providing “health and social services,” as defined by the Elder Abuse Act. Case settled on terms favorable to clients, relatives of resident who died shortly after removal of emergency call service.
  • Obtained favorable result for policy-owner in mediation in Northern District case concerning negligence of insurance company and agent in facilitating misappropriation of life insurance proceeds.
  • Represented insurance company in arbitration of contract dispute with insurance agency. Dispute was resolved with client receiving approximately 90% of amount sought under contract.
  • Obtained favorable result for designated beneficiary in mediation involving designation on retirement account which conflicted with terms of marital dissolution agreement.
  • Obtained favorable result for designated beneficiary in mediation involving joint tenancy designation on investment account, where respondent challenged designation as product of undue influence.
  • Obtained favorable result in settlement conference in Northern District case against Department of Homeland Security involving wrongful deportation of client while his application for political asylum was pending.
